The 78-year-old man who threw mud at ACT MP John Banks outside a court appearance on Monday, has now made a bizarre accusation against the former Auckland mayor through a legal representative.

Castislav Bracanov, who has a history of serial throwing, claims that Banks was fully aware he would have mud thrown at him prior to the incident, and in fact asked Bracanov to split his mud into two separate amounts, so that he wouldn’t get too messy “all at once.”

Bracanov said he complied with Mr. Banks’ request, but now believes he asked for the amounts to be split knowing full well that there would never be an opportunity to hit him with the second amount.

“My client is deeply upset and hurt by the actions of Mr. Banks,” wrote Bracanov’s lawyer, Samuel Jennings, “who he believes knowingly deceived him for his own personal gain.

“At the time that Mr. Banks spoke with my client, he not only asked for the mud to be separated in two, but requested that the second load of mud be the larger one.

“He argued to my client that this would make the second throwing ‘more spectacular,’ but in retrospect, it is clear that this was a transparent attempt to avoid being hit with the majority of the mud.”

Asked why Banks would allow himself to be hit with mud at all, rather than reporting the plot to police, Jennings said he believed the ACT MP was trying to engender sympathy from the court.

“I think that it’s clear to anyone who’s seen the video, that Banks is sort of, you know, the way he reacts, he’s clearly expecting it.

“He acts surprised at first, but then he stares at my client and does his classic, loveable ‘I’m-full-of-hate-and-I’m-going-to-murder-you’ look, which he knows is something that people find quite charming about him.”

Before he was advised not to, Mr. Bracanov spoke to media himself earlier this morning, appearing on TV One’s Breakfast programme, where he yelled obscenities at host Rawdon Christie and did a loud impression of a washing machine.
